Wisconsin’s Largest Business Group Sues Over Evers’ 400-year School Funding Veto

Image
There is now a legal challenge to Gov. Tony Evers’ 400-year school funding veto. The WMC Litigation Center on Monday asked the Wisconsin Supreme Court to take up their challenge to the governor’s summer veto that increased per-pupil funding for the next four centuries. “At issue is Gov. Evers’ use of the so-called ‘Vanna White’ or ‘pick-a-letter’ veto,” the group said in a statement. “The governor creatively eliminated specific numbers in a portion of the budget bill that was meant to increase the property tax levy limit for school districts in the 2023-24 and 2024-25 fiscal years. By striking individual digits, the levy limit would instead be increased from the years 2023 to 2425 – or four centuries into the future.” The WMC Litigation Center is an affiliate of Wisconsin Manufactures & Commerce (WMC), the combined state chamber and manufacturers’ association. Litigation Center Executive Director Scott Rosenow said while Wisconsin’s governor has an incredibly powerful vet...

WILL: Wedding Barn Rules Regulates Them Out of Existence

Image
A legal challenge to Wisconsin’s new rules for wedding barns may already be in the works. The Wisconsin Institute for Law and Liberty told The Center Square it is in the process of talking to wedding barn owners across the state about the next steps after it says the Wisconsin Legislature essentially voted to put them out of business. Lawmakers at the Capitol voted on a sweeping overhaul of Wisconsin’s liquor laws. In addition to making changes for breweries, wineries, distributors and small shops, the overhaul includes new regulations for wedding barns. “Barns can still host events, but those events can no longer involve the consumption of alcoholic beverages unless the barn owner does one of two things – either obtain a liquor license, essentially become a tavern, or obtain a ‘no sale event venue permit’ from the state. If they get that permit, they can only have six events per year where alcoholic beverages are served, and no more than one per month, and they can only allow ...

WILL Asked to Join Supreme Court Case Over School Choice in Wisconsin

Image
The legal fight over school choice in Wisconsin could be growing. The Wisconsin Institute for Law and Liberty asked to join the Supreme Court case that would end the state’s school choice programs. “On behalf of our clients and about 65,000 students who benefit from Wisconsin’s choice programs, WILL stands ready to defend the rule of law and the educational freedoms afforded to students and families alike,” WILL President and General Counsel Rick Esenberg said in a statement. Progressive activist and frequent candidate Kirk Bangstad filed a lawsuit last month that says Wisconsin’s four taxpayer-funded school voucher programs are unconstitutional. Bangstad is asking the liberal-majority Wisconsin Supreme Court to strike down those programs and send the money that choice students receive back to the state’s public schools. WILL’s argument is the lawsuit is too broad, wrong and asks the court to end “settled law.” “[Bangstad’s] arguments are factually incorrect and that gran...

Planned Parenthood to Resume Abortions in Wisconsin

Image
The legal challenge to Wisconsin’s pre-Roe abortion law could move more quickly after Planned Parenthood announced Thursday it will resume providing abortions in the state. “With the recent confirmation from the Court that there is not an enforceable abortion ban in Wisconsin, our staff can now provide the full scope of sexual and reproductive health care to anyone in Wisconsin who needs it, no matter what,” President and CEO of Planned Parenthood of Wisconsin Tanya Atkinson said. Planned Parenthood plans to resume performing abortions Monday. A Dane County judge ruled in July Wisconsin’s pre-Roe abortion law didn’t apply to abortions. Judge Diane Schlipper said there is no such thing as an ‘1849 Abortion Ban’ in Wisconsin,” she said the state’s ban on abortion, instead, applies to feticide. Gov. Tony Evers praised Planned Parenthood’s announcement. “This is great news, but our fight to restore the same reproductive freedoms Wisconsinites had up until the day #SCOTUS overt...

WILL Wants Supreme Court to Review First Amendment Challenge to Mandatory Bar Membership

Image
The next legal fight over whether someone has to belong to a group as a condition to do their job may be coming to a courtroom soon. The Wisconsin Institute for Law and Liberty on Monday asked the United State Supreme Court to take once again a look at mandatory bar membership in the state. “For far too long, this Court’s precedents have allowed States to put attorneys to the choice of either losing their ability to earn a living in their profession or associating with and funding opinions with which they disagree,” WILL argued in its amicus brief. WILL is calling the challenge a First Amendment case. [caption id="attachment_94848" align="alignleft" width="189"] ANTHONY LOCOCO Deputy Counsel[/caption] “Forcing objecting attorneys to join and fund an organization that engages in speech with which they disagree is contrary to fundamental values of free speech and free association,” WILL Deputy Counsel Anthony LoCoco, said. “If the State Bar wants ...
